SINGLE EMPLOYEE RETRENCHMENTS
In terms of Section 191 (5) (b) of the Labour Relations Act No 66 of 1995, an employee may refer a dispute to the Labour Court for adjudication if the employee has alleged that the reason for dismissal is: “… (ii) based on the employers operational requirements”.

CRIPILING MOTOR INDUSTRY STRIKE COMES TO AN END

The two week strike in the motor industry came to an end early this week when a settlement agreement was signed by the parties on the 25th of September 2007. This was to great relief of all parties. As mentiod before, several South African motor manufacturers were badly affected by the strike, which forced them to shut down production facilities due to a lack of parts.

Some of the final wage increase percentages that have been agreed to are the following:

  • Grade 1 (Chars) will receive a 10 % increase per year over the next three years.
  • Forecourt attendants will receive a minimum wage of R 509.00 per week and this is applicable to all areas. Thereafter they will receive an 8 % increace for the second year and 7.5 % for the third year.
  • Grade 1 (Parking Garage attendants and watchman) as well as Grade 2-4 will receive 9 % for year one, 8 % for year two and 7.5 % for year three.
  • Grade 5-6 receives a 9% wage increase for the first year, 8 % for the second year and 7.5 % for the third year.
  • Grade 7-8 and Division B employees will receive an 8% increase for the first year, 7.5 % for year two and 7 % for year three.
  • Apprentices receive a 12 % increase for the first year, 11 % increase for the second year and a 10 % increase for the third year.

The effective date for implementation will be determined by the Minister of Labour when the agreement is published in the Government Gazette. The effective date is expected to be towards the end of October or early November 2007.
